Rules and Regulations Prescribing the Conditions, Limitations and Privileges to Which Every Lot in New Palestine Cemetery is Subject Too
The following bylaws have been set forth and regulated by members of the New Palestine Cemetery Board. These guidelines have been for the sole function of maintaining the cemetery property as well as the safety and respect of those interred or visiting the cemetery. Those with contractual right of interment/burial on cemetery property, also agree to the following terms in regards to structures on the grave sites.
- The proprietor of each lot shall have the right to erect proper stones, monuments or sepulchral structures strictly subject to the regulations governing the same.
- Suitable corner stones to mark the boundaries of lots will be put in by the Association
- All persons are prohibited from planting trees, shrubs, plants or flowers on lots or graves in New PalestineCemetery. Flowers are permitted in vases or urns and cut flowers placed upon the graves will be removed as soon as they become faded and unsightly In appearance.
- If any trees or shrubs, situated in any lot shall, by means of their roots, branches height or otherwise become detrimental to the adjacent lots, walks, or avenues, or dangerous or inconvenient to passengers, it shall be the duty of the Managers and they have the right to enter into said lot and remove the said trees or shrubs or such parts thereof as are thus detrimental, dangerous or inconvenient.
- All lots will be kept in order free of expense to the owner, provide said lot is endowed.
- Lots shall not be used for any other purpose than as a place of burial for the dead; and not trees within the lots or borders shall be cut down or destroyed without the consent of the Board of Directors.
- If any monument, effigy, or any structure whatever, or any inscription be placed in or upon any lot which shall be determined by the Board of Directors to be offensive or improper or injurious to the appearance of the surrounding lots or grounds, the said Board of Directors shall have the right, and it shall be their duty to enter upon such lot and remove the said offensive and improper object or objects.
- Proprietors shall not allow interments to be made in their lots for remuneration. All interments in lots shall be restricted to the members of the family and relations of the proprietor thereof, except special permission to the contrary be.
- All deeds when executed shall be construed as simply granting to the proprietor of the lots conveyed the right to use said lot for burial purposed for the interment of himself, his family, his relations and descendants and such other persons as he shall have the permission of the Secretary to bury thereon as above provided. But such burial right shall be personal to himself and persons above named; and such right shall not be transferable either by voluntary or involuntary conveyance to any other person or persons without the express consent of the Board of Directors f the New Palestine Cemetery.
- All lot owners are prohibited from selling their lots in whole or in part, or from transferring the same, without the express consent of the Board of Directors of the Cemetery.
- Private fences or enclosures around lots will not be allowed.
- No interments are allowed until the payment for the lot is provided for as required by the regulations prescribed for the purchase of lots; and if at any time any note or notes, executed upon the execution of a conditional contract for the purchase of a lot, shall be past due, not further interment shall be allowed thereon until such note or notes shall either be paid or the prompt payment thereof secured to the satisfaction of the Board of Directors.
- All graves shall be dug by workmen in the employ of the corporation, for which reasonable charges will be made.

- No enclosures of any kind are allowed around graves
- No trees, plants or shrubs in the corners of lots as boundary marks allowed.
- No mounds on graves will be permitted. All graves to be made, sodded and cared for by the Cemetery Association.
- Lot owners are prohibited from placing on lots or graves all toys, cases, boxed, globes, shells, brit-a-hrac of every description; any such articles found on the cemetery grounds will be removed.
- No wooden benches, chairs, settees, headboard or wooden articles of any kind allowed on the grounds.
- Heavy loads will not be allowed to enter, unless by permission of the Custodian.
- The grading of all lots must be under the direction of the Custodian and by hands employed regularly on the grounds.
- No memorial or other structure shall be erected or permitted on a lot until all charges have been paid in full and the cemetery has been contacted.
- No memorial or other structure shall be erected without a foundation, measuring with a six inch border around the perimeter of the base of the structure. No cremains to be placed in foundations.
- No monument, foot stone, marker or memorial of any description shall be placed, moved, altered, or removed without permission from the Cemetery Board.
- The Cemetery Board will take reasonable precautions to protect the property of interment rights holders, but it assumes no liability for the loss of, or damage to, any monument, marker, or other structure including the foundation, or part thereof.
- The Cemetery Board Members reserve the right to determine the minimum and maximum size of monuments, as well as their location on each lot or plot. They must not be of a size that would interfere with any future interments or spaces owned by other property holders. The minimum thickness for a flat marker is 4 inches.
- All foundations for monuments and markers shall be built by, or contracted to be built for the Cemetery Board, at the expense of the interment rights holder, who is responsible for any future repairs or replacement of the foundation.
- Should any monument or marker present a risk to public safety because it has become unstable, the Cemetery Board has the right to take the necessary measures to repair, reset, or lay down the monument/marker to remove the risk. Foundations are property of the rights holders.
- The Cemetery Board reserves the right to remove, at its’ sole discretion, any marker, monument, or inscription which is deemed offensive or that does not adhere with the dignity and decorum of the cemetery, as determined by the Board Members.
- In keeping with the cemetery by-laws, only one monument shall be erected within the designated space on any lot. Additionally, all monuments and markers shall be constructed of bronze or natural stone (i.e. granite)
